General terms and conditions of business

1 SCOPE
  1. The following general terms and conditions, hereinafter referred to as General Terms and Conditions, apply to all contracts concluded with BLAUMAX Handelsges.mbH, based in 3400 Klosterneuburg, Inkustraße 13, hereinafter referred to as BLAUMAX, for goods purchased online, by telephone or in writing.
  1. If the customer enters into business relationships with BLAUMAX by using the website, he accepts the General Terms and Conditions as the basis for the entire business relationship between the customer and BLAUMAX. BLAUMAX does not recognize the customer's deviating conditions unless BLAUMAX management has expressly agreed to their validity in writing. Contractual fulfillment actions on the part of BLAUMAX do not constitute consent to conditions that deviate from the BLAUMAX General Terms and Conditions.

 2 CONCLUSION OF CONTRACT

  1. The goods and information shown on the BLAUMAX website or in the BLAUMAX catalogs only represent non-binding product information and not a binding sales offer. By pressing the “buy” button, you place a binding order for the goods contained in your shopping cart. Confirmation of receipt of the order by an automated email does not constitute acceptance of the contract. Acceptance of the contract only takes place via an order confirmation or shipping confirmation sent by email. BLAUMAX can accept an order within 5 working days.
  1. If BLAUMAX cannot accept the customer's offer or if certain products in the order are no longer available, the customer will be informed of this immediately.
  1. In the event of typographical, printing or calculation errors on the website or in the product catalogue, BLAUMAX is entitled to withdraw from the contract.
  1. All offers are valid while stocks last.
  1. If BLAUMAX does not accept an order, the purchase price already paid will be refunded within 15 days or, if requested, offset against other goods.
  1. The customer has the right to withdraw within 15 days, calculated after the goods have been dispatched by BLAUMAX.

INSTRUCTIONS ON THE RIGHT OF WITHDRAWAL

  1. You can cancel your order no later than 15 days after delivery or attempted delivery of the goods. To meet the withdrawal deadline, it is sufficient to send the declaration of withdrawal in a timely manner by email, fax or letter or, if already delivered, to return the goods.
  1. The right to withdraw and to fully return the purchase price paid only applies to products that are returned in the same condition as delivered. The goods may not be worn or used in any other way. Only an examination of the properties and functionality, as is possible and usual in a retail store, is permitted
  1. In addition to the item itself, labels, tags, product instructions and packaging must also be returned. If this is not the case, or if the goods have been used, worn or washed, the refund may be refused or the refunded purchase price may be reduced.

RETURNS/EXCHANGES

  1. If you are not satisfied with the items you ordered, you can return them within 15 days of receiving your order.

     The return can be made free of charge to a post office of your choice using the enclosed return label.

  1. Consequences of resignation
    In the event of an effective withdrawal, the services received by both parties must be returned. For returns that are not disputed, BLAUMAX will refund the purchase price within 21 days of receipt of the goods. In the event of objections, the customer will receive a corresponding notification and, if necessary, a refund less a deduction for defects or missing parts. In any case, BLAUMAX reserves the right not to refund the purchase price for returned goods that are not reasonable for further sale.

     BLAUMAX bears the costs of return shipping within the European Union.

     If the goods you ordered do not fit and you would like to exchange the goods for a different size or color, we ask you to place a new order for the desired product.
3 DELIVERY
  1. Unless otherwise agreed, delivery will be made to the delivery address specified by the customer .
  1. Shipping takes place via Austrian Post.
4 DUE DATE AND PAYMENT, DEFAULT
  1. All BLAUMAX product prices include VAT and are stated in euros. The prices are valid at the time of the order including sales tax, plus all shipping costs until revoked.

    In the case of cross-border delivery, additional taxes (e.g. in the case of an intra-community purchase) and/or duties (e.g. customs duties) may be payable by the buyer in individual cases, but not to the seller, but to the responsible customs or tax authorities there.

    The shipping costs incurred will be borne by the buyer or BLAUMAX depending on the country of delivery address and the amount of the invoice. The shipping conditions can be found under § 5 SHIPPING COSTS.
  1. The purchase price is due immediately upon placing the order.
  1. The customer can pay the purchase price by credit card (Visa, Mastercard), Paypal, Amazon Pay and instant bank transfer.
  1. BLAUMAX reserves the right to pledge or assign your purchase price claims due in connection with the delivery of goods to third parties.

  1. If the buyer incurs shipping costs, these will be shown separately during the ordering process.
  1. BLAUMAX will bear the costs of any return shipment from the European Union.

     The buyer is responsible for returns from other countries.
6 OFFSETTING, RETENTION

  1. The customer only has the right to offset if his counterclaims have been legally established or recognized by BLAUMAX. The customer is only authorized to exercise a right of retention to the extent that a counterclaim is based on the same contractual relationship.
7 RETENTION OF TITLE

  1. The goods remain the property of BLAUMAX until full payment has been made.
8 WARRANTY
  1. In the event of defects in the goods, BLAUMAX adheres to the statutory warranty regulations in Austria. This is 2 years and begins from the time of receipt of the goods.
  1. Obvious transport, material or manufacturing defects must be reported immediately.
  1. The warranty does not cover normal wear and tear from use. Likewise, it does not extend to fashion effects such as a vintage look.
  1. If there is a defect in the purchased item for which BLAUMAX is responsible, BLAUMAX is entitled, at its own discretion, to remedy the defect or to deliver a replacement. If BLAUMAX is not willing or unable to remedy the defect/replacement delivery or if this is delayed beyond reasonable deadlines for reasons for which BLAUMAX is responsible, or if the remedy of the defect/replacement delivery fails in any other way, the customer is entitled, at his own discretion, to To withdraw from the contract or to demand a corresponding reduction in the purchase price.
  1. If a warranty claim occurs with a product purchased in the online shop, the customer can return the goods to the contact address provided. If it turns out that there is no defect that is subject to warranty, BLAUMAX will charge the customer for the expenses incurred.
  1. Compensation for (defect) consequential damage, as well as other property damage, financial loss and damage to third parties against the customer, unless it is a consumer transaction, is excluded.
9 IMAGE RIGHTS
  1. The rights to the online images and illustrations belong to BLAUMAX and use without express written permission is not permitted.
10 PRIVACY
  1. BLAUMAX's data protection declaration can be found at www.blaumax.com .
11 OTHER
  1. Should a provision in these terms and conditions become ineffective, this will not affect the effectiveness of all other provisions. Invalid provisions will be replaced by those legally permissible provisions that come closest to the economic purposes intended by the parties.
  1. The place of performance for entrepreneurial transactions is the BLAUMAX company location. For any legal disputes arising from this contractual relationship, the exclusive subject-matter and local jurisdiction of the Klosterneuburg District Court is agreed.
